Privacy Policy

This Privacy Policy explains how Matthew James Creative, LLC (“MJC,” “we,” “us,” or “our”) collects, uses, shares, and retains information in connection with this website. It forms part of our Terms of Service and should be read together with our Acceptable Use Policy and any service-specific agreement you have with us.

01Scope & Who We Are

  1. Who We Are: MJC is a website development and digital visibility company based in Pittsburgh, Pennsylvania, operating since 2006.
  2. What This Covers: This policy covers matthewjamescreative.com and the forms, pages, and communications offered through it.
  3. What This Does Not Cover: It does not cover the client websites we build, host, or optimize, each of which publishes its own privacy notice covering the information its visitors provide. It also does not cover third-party sites we link to.
  4. Business Contacts: We operate a business-to-business practice. The information we collect is ordinary business-contact information provided voluntarily by people inquiring about our services.

02Information We Collect

  1. Information You Give Us: When you submit our contact or audit-request form, or email or call us, we collect what you provide — typically your name, company, email address, phone number, website address, and anything you choose to include in the message field. Please do not send us sensitive personal information (for example, payment card numbers, government identifiers, or health information) through the form.
  2. Information Collected Automatically: Like most websites, our servers record standard technical data when you visit — IP address, browser type and user agent, referring page, pages requested, and date and time.
  3. Form and Anti-Spam Records: To detect and block spam and abuse, our form handler records your IP address, browser user agent, and the date and time alongside each submission, together with a copy of the submission’s contents. This includes submissions our spam filter blocks, so that we can identify and correct false positives.
  4. Cookies and Analytics Data: We use cookies and similar technologies to operate the site, protect it from abuse, and understand how it is used. See sections 4 and 5.
  5. Information From Other Sources: In the ordinary course of business we may receive information about you from your employer, a colleague who refers you, or publicly available business sources.

03How We Use Information

  1. Responding to You: To answer inquiries, prepare and deliver a requested audit or proposal, and communicate about services you have asked about.
  2. Providing Services: To deliver, support, invoice for, and improve services under an agreement with you.
  3. Site Operation and Security: To operate, maintain, secure, and troubleshoot the site, and to detect, prevent, and investigate spam, fraud, abuse, and technical problems.
  4. Analytics and Improvement: To understand aggregate traffic and usage patterns and improve our content, structure, and performance.
  5. Business Communications: To send you information about our services where you have requested it. We do not add form submissions to a newsletter or marketing sequence, and you can opt out of any communication at any time.
  6. Legal and Compliance: To comply with law, enforce our agreements, and establish, exercise, or defend legal claims.

04Cookies & Similar Technologies

  1. What They Are: Cookies are small files placed on your device. We and our service providers may also use similar technologies such as pixels, local storage, and server logs.
  2. Categories We Use: (a) Essential — needed for the site and its forms to function and to protect against abuse; (b) Analytics — to measure traffic and usage; and (c) where applicable, advertising and measurement technologies used to evaluate our own marketing.
  3. Your Control: Most browsers let you refuse or delete cookies, and analytics providers offer their own opt-outs (see section 5). Blocking cookies may affect how parts of the site function.

05Analytics & Third-Party Services

  1. Google Analytics: We use Google Analytics, delivered directly or through Google Tag Manager, to understand how visitors find and use this site. It collects information such as IP address, device and browser characteristics, approximate location, pages viewed, and time on page. Google processes this data under its own privacy policy. You can opt out site-wide using Google’s opt-out browser add-on.
  2. Spam Protection: Our contact form is protected by checks that run on our own server — hidden fields that automated scripts fill in but people never see, a timing check, and content heuristics. These do not involve a third party. If we add a third-party CAPTCHA service in future, we will update this section before it goes live.
  3. Typefaces: Our pages load their typefaces from our own server. No font request is made to Google or any other third party, so no IP address or browser information is transmitted to a font provider when a page loads.
  4. Hosting and Email: Our site is hosted on managed infrastructure and our business email is provided by a third-party provider. These providers process data on our behalf to deliver their services.
  5. No Control Over Third Parties: We do not control, and are not responsible for, the data practices, changes, outages, or defects of third-party services. Their handling of data is governed by their own terms and policies.

06How We Share Information

  1. We Do Not Sell Your Information: We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
  2. Service Providers: We share information with vendors who perform services for us — hosting, email delivery, analytics, spam filtering, and professional advisors — and who are permitted to use it only to provide those services.
  3. Legal Requirements: We may disclose information where required by law, subpoena, or other legal process, or where we believe disclosure is necessary to protect our rights, safety, or property, or that of others.
  4. Business Transfers: If MJC is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
  5. With Your Direction: We share information as you direct or authorize — for example, when coordinating with your hosting provider, registrar, or platform vendor on your behalf.

07How Long We Keep Information

  1. Inquiries and Correspondence: We retain inquiries and business correspondence for as long as needed for the business relationship and for our legitimate business, accounting, and legal purposes.
  2. Form and Anti-Spam Records: The form and anti-spam records described in section 2 are generally retained for approximately twelve (12) months and then removed on a rolling basis.
  3. Web Server Logs: Standard web server access logs are kept by our hosting environment for as long as we need them for security, troubleshooting, and record-keeping purposes. They are not used to build a profile of you.
  4. Analytics Data: Analytics data is retained according to the retention settings of the analytics provider.
  5. Deletion Requests: You may ask us to delete information we hold about you (see section 8). We may retain what we are required to keep by law or need to resolve disputes and enforce agreements.

08Your Choices & Rights

  1. Access, Correction, Deletion: You may request a copy of the information we hold about you, ask us to correct it, or ask us to delete it. Email us at the address in section 16 and we will respond within a reasonable period.
  2. Opting Out of Messages: You can opt out of business communications at any time by replying to any message and telling us, or by emailing us directly. We will still send transactional or service-related messages relating to an active engagement.
  3. Cookies and Analytics: You can manage cookies in your browser and opt out of Google Analytics using Google’s opt-out browser add-on. Browser settings and extensions can also block third-party requests, though blocking them may change how pages render.
  4. Verification: To protect your information, we may need to verify your identity or authority before acting on a request.
  5. No Discrimination: We will not deny you services, charge you a different price, or provide a different level of service because you exercised a privacy right.

09California Residents

  1. Your Rights: Where the CCPA as amended by the CPRA applies to us, and as a matter of practice regardless, we honor the right of California residents to know what personal information we collect, use, disclose, and retain; to request deletion or correction; and to opt out of sale or sharing.
  2. Sale and Sharing: As stated in section 6, we do not sell personal information and do not share it for cross-context behavioral advertising.
  3. Categories: The categories of personal information we collect are identifiers (such as name, email address, phone number, and IP address), commercial information (such as services inquired about), and internet or network activity information (such as pages viewed). We collect these directly from you, automatically from your device, and from the other sources described in section 2, for the business purposes described in section 3.
  4. How to Exercise: Submit requests using the contact details in section 16. You may use an authorized agent, subject to verification.

10Visitors Outside the United States

  1. Where Data Is Processed: MJC operates in the United States, and information we collect is processed and stored in the United States. Data protection laws there may differ from those in your country.
  2. Your Rights Where Applicable: Where the GDPR or UK GDPR applies to our processing, you have rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with your supervisory authority.
  3. Our Legal Bases: Where required, we rely on your consent, the performance of a contract with you, our legitimate interests in operating and securing our business and website, and compliance with legal obligations.
  4. Using the Site: By using this site or contacting us, you understand that your information will be processed in the United States as described in this policy.

11Security

  1. Our Measures: We use commercially reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction.
  2. No Guarantee: No website, server, or method of electronic transmission is completely secure. We cannot guarantee absolute security, and you transmit information to us at your own risk.
  3. Your Responsibility: You are responsible for the security of the device, network, and email account you use to communicate with us and for any credentials you hold.
  4. Limitation: The disclaimers and limitation of liability in our Terms of Service apply to this policy to the fullest extent permitted by law.

12Children’s Privacy

This site is directed to businesses and is not intended for children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us information, contact us and we will delete it.

  1. Outbound Links: This site links to third-party websites. We are not responsible for their content, security, or privacy practices.
  2. Client Sites: This policy covers matthewjamescreative.com only. The client websites we build, host, or optimize each publish their own privacy notice, and any information you provide on one of them is governed by that notice rather than this policy.

14Do Not Track

There is no consistent industry standard for responding to browser “Do Not Track” signals. This site does not currently respond to them. We will update this section if a common standard is adopted.

15Changes to This Privacy Policy

We may update this Privacy Policy at any time by posting the revised version on this page with a new “Last updated” date. Material changes will be reflected here, and your continued use of the site after changes are posted constitutes acceptance of the revised policy.
